General Terms and Conditions (GTC) – NUIT Apartments

§1 Scope of Application
These General Terms and Conditions apply to the rental of holiday apartments by NUIT Apartments via the website, as well as all other booking channels such as email and telephone.

§2 Booking Confirmation
The reservation for the holiday apartment becomes binding upon receipt of the booking confirmation. In addition, payment must be received before check-in. Otherwise, check-in is not possible.

§3 Payment Terms
Unless otherwise agreed, the total amount must be paid to the landlord no later than 7 days after receipt of the booking confirmation.

§4 Cancellation by the Guest
Cancellation by the guest must be made in writing. The following cancellation conditions apply: Up to the 42nd day before arrival: free of charge Up to the 28th day before arrival: 30% of the rental price Up to the 21st day before arrival: 50% of the rental price Up to the 14th day before arrival: 70% of the rental price From the 13th day before arrival: 90% of the rental price In case of no-show: 100% of the rental price We strongly recommend purchasing travel cancellation insurance.

§5 Cancellation by the Landlord
The landlord may terminate the rental agreement without notice after the start of the rental period if the tenant persistently disturbs other tenants or residents despite a warning, or behaves in such a way that immediate termination of the agreement is justified. In the event of force majeure or other unforeseen circumstances (e.g. water pipe breakage), we reserve the right to cancel the booking. Any payments already made will be fully refunded. Further claims are excluded.

§6 Arrival and Departure
(1)Check-in: from 3:00 PM / Check-out: by 11:00 AM
(2)Individual check-in and check-out times are possible upon prior agreement.

§7 Rental Property
(1) The holiday apartment is rented with full inventory to a person of legal age. Any missing items, defects or damages must be reported to the landlord immediately. Complaints regarding the condition of the apartment or its inventory will only be accepted if reported within 24 hours of arrival. The inventory must be treated with care and may only be used within the apartment. The tenant is liable for all damages caused by the culpable violation of their duty of care or reporting obligation, especially in cases of improper use of technical equipment or furnishings. The tenant is also liable for the actions of accompanying guests. Damages caused by force majeure are excluded.
(2) In the case of a breach of contract, such as subletting, overcrowding, disturbing the peace, organizing parties, or failure to pay the full rental price (§3), the landlord is entitled to terminate the contract without notice.

§8 Use of the Holiday Apartment
The apartment may only be occupied by the number of persons specified in the booking. Additional guests must be reported to the landlord immediately. In the case of overcrowding, the landlord reserves the right to refuse extra persons or to charge an appropriate additional fee. Smoking is strictly prohibited in the apartment.

§9 Landlord’s Liability
The landlord is liable within the scope of the duty of care for the proper provision of the rental property. Liability for possible outages or disturbances in the water or electricity supply, as well as incidents and consequences due to force majeure, is excluded.

§10 Severability Clause
If individual provisions of these GTC are or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a valid and enforceable regulation shall apply that comes as close as possible to the intended economic purpose of the invalid provision.

§11 House rules
1. Check-In is at 15:00, Check-Out is at 11:00. Early check-in or late checkout may be available upon request. Guests who stay beyond their designated checkout time or delay our housekeeping staff are liable for any associated costs and expenses.

2. Guests are not allowed to make a reservation in their city of residence. Please contact us if you're booking within your city.

3. Smoking, parties, and excessive noise are not allowed, including on balconies and in shared spaces. Smoking violations are subject to a 250€ fine plus the cost to clean, deodorize, and repair damages.

4. Commercial photography/videography without written consent and Illegal activity is strictly prohibited.

5. Overnight guests that exceed the number stated in the reservation are not allowed.

6. Pets are not allowed. Violation of our pet policy may result in a fine. We encourage guests with service animals to contact us before their stay.

7. Guests are responsible for covering the cost to replace lost keys, key cards, fobs, or parking passes.

8. Noise detecting technology may be used inside the apartment to monitor excessive noise levels.

9. Guests take full responsibility for damages, injury, or loss that occur on the premises and its facilities. Guests must report any property damage to customer service.

10. Booking a reservation constitutes an agreement to comply with the House Rules. Guests who violate these rules are liable for any associated damages, fees, costs, or expenses. Violation of house rules may lead to immediate cancellation of reservation and eviction without refund.

§12 Jurisdiction

German law applies. The place of jurisdiction is the registered location of the landlord, provided the guest is a commercial entity or legal person.
